"I've had enough. I'm going to fight!" Charlevoix County Businessman,
Lyle Barkley, has been ordered to remove two manufactured homes from a
4-acre parcel in Bay Township by September 18. Barkley says he will not
comply with the illegal and unconstitutional order of the court but will
defend his property with arms if necessary. Barkley, 55, owns B&B
Excavating in Boyne City. He is presently bulldozing fortifications around
his property in preparation for the standoff he promises will come if
officials attempt to remove the homes from his land. His cause has drawn
the attention of Rick Stanley, leader of an organization called Mutual
Defense Pact 2d American Revolution Militia who offers to send more than
600 armed defenders to Barkley's aid once the standoff has begun.

CONDITION CRITICAL Judge Richard May,
Presiding Judge of the 90th District Court, denied the Demand For Ex
Parte Order submitted to him on Monday afternoon. The Barkleys were
faxed a copy of his Opinion & Order late this afternoon. Judge May
could have rescinded his order pending an appeal to the Circuit Court,
or issued a Stay Of Execution. He did neither. In fact his actions have
escalated the situation. This can only indicate his resolve to
resort to the use of force, and avoid allowing additional time to reach
a peaceful solution. The Appeal to the Circuit Court has been drawn up
and is ready to be submitted on the morning (9-17-03). Judge May has
ordered that the Barkleys submit a bond of $7,800.00 (fine) prior to
his approval to have the matter moved to the Circuit Court. The
Barkleys do not have this kind of money. Both Mr. Barkley and his wife,
who is a co-defendant, are indigent and disabled. The appeals will be
filed with the Courts, the attorneys for Bay Twp. and Charlevoix County
Building & Zoning, as well as a copy given to Sheriff Lassiter,
first thing in the morning. Although these parties have to accept the
Appeal documents, they will probably not act on them because of the
inability of the Barkleys to pay the bond (fine). As I write,
a dedicated patriot is drawing up a motion to declare the Barkley's
indigent, and also a request to waive the bond and get an emergency
hearing. We hope to get these documents included with the Notice of
Appeal in the A.M. By his actions, Judge May has shown nothing but
contempt for the lives and well-being of the Barkley family and their
children, as well as contempt for the Constitution itself. He is
ultimately responsible for what takes place very shortly. It is all
boiling down to "if you don't have lots of money" you cannot appeal.
The Chickenhawks have raised the ante, If nothing positive occurs in
the morning, their hand needs to be called.
STANLEY NOTE: I spoke
with Lyle Barkley tonight. While unhappy with Judge May's decision, he
is still vowing to defend his property. I told him the Pact would
defend his position, regardless of what he decided. There are
other legal maneuvers to be tried in the Court but the hour is drawing
to a close. The Pact is at 690 members now after gaining some today,
and losing one to resignation, and one was removed as a provacatuer and
disruptive influence. There are more coming out of the woodwork as this
gets closer. They have no intention of coming on the trip to defend, so
they are trying to disrupt. Still have a few quiet sleepers but time
will tell, as it always does. The only damage is to that little old
lightning rod, Rick Stanley, who is used to it. Any member dealing with
a Chuck Geshlider of Texas, be advised he is the ex-Pact member
relieved of his committment to the Pact, and the Pact has no
recognition of him, from this evening on. One less provacatuer to deal
with. We welcome all provacatuers to the Pact so that they may be
exposed for the scum and traitors that they are to America, the real
America. We will delight in their exposure. I will take personal
pleasure in the exposures.
I understand from talking with Lyle
tonight that two more militia's from Michigan have committed to the
defense of the Barkley property. One with weapons and one without. I
guess they are going to throw dirtclods at the sheriffs. Just kidding
folks. They will decide in their own time what is the proper response
to an attack upon the Barkleys. I believe per Lyle that these are
a southern Michigan group and an eastern Michigan group. No numbers
have been mentioned as to what they can bring to the Barkley table. I
understand another Militia group from Michigan is offering their
services, the Michigan Wolverines of Commander Clint Dare. No knowledge
of acceptence by the Barkleys of their offer made through a local
newspaper as of today.
The Pact remains committed to the Barkley
defense and remains on PRELIMINARY ALERT for the Barkley Militia
Alert.

HORTON BAY- A violent
confrontation over a land dispute in Bay Township should be avoided, all
involved said Monday.
But Charlevoix County Sheriff George T.
Lasater insisted he'll follow the county district court's orders, which
call for the removal by Thursday of three manufactured homes from four
acres owned by Lyle Barkley off Camp Daggett Road.
Motions were filed with the
court today to seek an injunction against the ruling by Judge Richard May
to stop the pending action against Lyle Barkley. It was reluctantly
accepted by a clerk who filed it with the 90th District Court of Richard
May, the same Judge who ordered the action against Lyle Barkley! It is
highly doubtful that May will overrule his own judgment in the matter, nor
is it likely that it will speed through the system to another court that
could overturn or stop May's order. This is not good news.

Update.....Barkley Family In Michigan Greetings
Norm,
I would like to update you on todays events at the Barkley
residence. I took a Demand For Ex Parte Order to the Barkleys late this
morning. The Demand was that Judge May withdraw/rescind his order to
forceably remove the mobile homes from the Barkley land on 9-18-03. The
Barkleys also asked him to issue a restraining order against Bay Twp and
Charlevoix County from taking any further action against them until all
their legal/lawful remedies were exhausted. They plan on appealing to the
33rd Circuit Court. Channel 7/4 news filmed Mr. Barkley signing the
Demand.
It was also signed by Shirley Barkley (wife) and Kimberly
Barkley (daughter). All three are Defendants in the action. The Demand for
Ex Parte Order was served on the Deputy Court Clerk, Paula Strange, in
person by myself. I was accompanied by Lyle Barkley, Kimberly Barkley, and
two neighbors, Robert Taylor and Juanita Miller. They all witnessed the
Court clerk accept the Demand and time and date stamp it, as well as sign
it. We had her sign and time and date stamp two other originals. One is in
the possession of Mr. Barkley, and the other is at the "Emerson Review" in
Frederic. Judge May was in Emmet County (Petosky) at the time.
The
Court Clerk called the court in Petosky to inform them she would be faxing
the Demand to them to deliver to Judge May. I watched as she faxed the
document. Judge May has until the close of business on Wednesday, 9-17-03
to issue the restraining order and withdraw his order to forceably remove
the mobile homes. I would presume he has already made his decision. There
may be (rumor) some federal pressure on him to comply with the Demand. Mr.
Barkley will call the 90th Circuit Court on Tuesday, 9-16-03, to see if
Judge May has acted on the Demand.
Should Judge May do what is
lawfully and morally correct, a stand down would be in order until legal
remedies are exhausted. Should Judge May do what is unlawful, immoral, and
unconstitutional, and not honor the Demand, then it would be only natural
and his God given right for Mr. Barkley to defend himself and his family
against any attack. I am sure he would accept all the help that was
offered to assist him in protecting his family and property.
There
would truly be a line drawn in the sand. I urge you to keep in close
contact with Mr. Barkley to keep up to date on the situation as it
unfolds, and govern yourself accordingly. Rumor also has it that the FBI
(Grand Rapids) has promised to investigate the Township and County for any
wrongdoings in regards to this matter and possibly others that may come to
surface.

It's kind
of a standoff between our township zoning enforcement here. Back in June
and August we took out zoning permits to put these trailer houses on our
property here and they were issued to us. And then come along the last
part of October and he said my one permit wasn't right. He said I had to
change it. Which I agreed to that. And when I tried to change it I spent
better than three weeks trying to get ahold of him and I couldn't get
ahold of him. So the next thing we get through the mail is that we've got
fourteen days to move this stuff out that it was in violation of the
zoning ordinance and they took us to court in February or March it was.
And at that time the Judge ruled that we move the trailer houses out and
give us 90 days and an $800 fine. And I couldn't see where we'd done
anything wrong.

that we just want are rights. We don't want any body to get hurt over the
situation. We would like people to stand beind us on this situation. It
sure hasn't been easy for any of us.

impressed, and he wrote:

racism and anti-semitism exists within the militia movement (it exists in
the anarchist movement too!) but at base is a class struggle. These people
are also generally libertarian in some sense (anti federal government) and

Bay Township resident threatens armed
confrontation over zoning dispute BY FRED GRAY NEWS-REVIEW STAFF WRITER
HORTON BAY - Lyle Barkley is bulldozing four-foot berms around his three
acres in Bay Township and requesting support from conservative militia
groups to prepare for a possible armed confrontation with county law
enforcement officers over a zoning dispute.
The 55-year-old
excavator vows that neither he, his family nor the three manufactured
housing units in dispute will be removed from his property without a
shootout. Lyle Barkley and his daughter, Kim, stand in front of one of
two manufactured homes that Charlevoix County District Judge Richard May
has ordered removed from their property in a zoning dispute with Bay
Township. Barkley and his daughter vow to fight any attempt to trespass on
their property and have enlisted the support of private militia
groups.
Last April District Judge Richard May granted a
township request that Barkley be ordered to remove the housing units from
his property on Camp Daggett Road.
When Barkley failed to act, May
found him in contempt on Aug. 28 and gave him until next Thursday to
comply or face 28 days in jail and over $7,800 in fines.
Barkley,
who appeared in district court without an attorney, said May's decision at
the request of the township amounted to an unconstitutional taking of his
property.
He maintained that his property is "patent land" granted
to the initial owner in 1871 by President U.S. Grant, and as such he has
rights to do with his property as he wants, irrespective of zoning laws.
He said May dismissed his argument and said he would not be allowed to
appeal the order.
But unlike many who hold patent land and dispute
any governmental authority over it, Barkley said he does not challenge the
right of government to tax his land.
"I pay my taxes," he said.
"But Judge May called my personal property junk, and so I feel I don't
have to pay taxes on junk."
Barkley, a native of Charlevoix County,
and his daughter, Kim, 22, live in separate houses on the property, and
both are subject to the court order. They have extensive files on the
dispute that go back years.
Barkley's predicament has drawn the
attention of Norman Olson of Alanson, senior adviser to the Michigan
Militia, and Rick Stanley, leader of the Denver-based Second American
Revolution Militia "Mutual Defense Pact."
Olson issued a press
release on Thursday, urging citizens throughout Michigan to become aware
of what is taking place and to speak out in an attempt to forestall or
stop armed conflict.
"Lyle Barkley is unlikely to run. He's
preparing to defend. I admire his spirit," Olson said, adding he did not
expect an armed confrontation to occur as a result of the court
deadline.
"These deadlines come and go. It's a bunch of hype. But
the situation stinks of crooked politics, corruption and favors," Olson
said.
Stanley, reached in Denver, said Barkley is a member of his
organization and could expect 670 armed supporters, including two dozen in
Michigan, to come to his assistance within four days of the onset of an
armed confrontation.
"Once he's defended himself and repelled any
attack, we'll send our militia, the largest in the U.S.," Stanley said.
But he said he considered it unlikely.
Charlevoix County Sheriff
George T. Lasater said that as the chief law enforcement officer for the
court, he would do whatever was required. But he said he did not
anticipate the dispute would come to armed confrontation.
"I don't
see this mushrooming out of control," Lasater said. "We'll do everything
in our power to make sure there are no injuries, including to police
officers, citizens and Lyle Barkley and his family."
Lasater said
Barkley had sent him a notice over the weekend that if he trespassed on
his property, he would be assessed a civil penalty of $1 million "to be
paid in silver coin."
Lasater said on one previous occasion in the
county several years ago a half dozen armed members of a militia group did
appear to back a landowner, but the matter was settled
peacefully.
Township supervisor Larry Moeschke and trustee Chris
Monk said in an interview today that the township considers the matter one
of compliance with the township zoning ordinance.
"Before he
brought the manufactured homes in, he already had two single-wide homes
legally on the property," Moeschke said. "He ultimately brought in two
additional single-wide mobile homes and what we call a modular school
house for a total of what we consider to be five homes on the
property.
"The Bay Township zoning ordinance allows one single
family residence but he was able to bring in the second home in the
mid-1990s under a caretaker clause."
"What he was doing was not
what he applied for," Monk said, adding: "There is no agenda, no favors.
We're merely trying to keep the character of Bay
Township."
Moeschke said the township doesn't have a blight
ordinance.
"We're not trying to dictate to anyone in the township
how their property should appear. All we want is simply compliance with
our zoning ordinance," he said.
County building official Ken Doty
said, "If there are no zoning permits and health department permits in
place, we cannot issue building permits. It's that simple."
Randy
Frykberg, the township zoning administrator, said the matter has been
settled in court and is a matter of public record. He said he would have
no further comment.

right-wing militia maniacs are mobilizing for a seige in Michigan. this is
being sparked by a guy who doesn't want to obey a court order about his
property. if you read the blog, these people sound pretty fucking serious
and willing to take up arms.
the reason why this should be of
interest to anarchists: if the situation reaches armed standoff between
authorities and militamen, the image of the violent state will crystalize.
rarely do we witness, in such a blatant manifestation, the state's arsenal
of violence on domestic territory. yea, sometimes during protests,
strikes, riots, police brutality, we see it. but not often and not in the
form of an armed battle.
also, isn't it amazing that the right-wing
militias can mobilize so quickly for an incident like the one in michigan?
not only do they mobilize, but their talk (and possibly action) is
shamelessly militant. the extreme right has no qualms about armed struggle
whereas the far left is stuck worrying about whether rock-throwing is OK
or not.
Maybe it's time for
one of the "anarchism is neither left wing nor right wing" folks to step
up to the bat and explain whether or not we should support this
man?

concluded a heated 14 minute phone call with Mr. Bell. He and I agreed

One is, Lyle Barkley himself. He loves life. He
cherishes freedom. He refuses to live as a slave. He owns land, and damn
it...he's gonna use it as he desires.

A remote controlled transmitting surveillance
camera has been erected on neighboring property overlooking the Barkley
home. The camera sets atop a 12' pole in a locked container with
an antenna. The camera's lens is colored red. The police
were summoned by the Barkleys to order the neighbor to take
the camera down since it invades privacy. The police have refused to
act. I advised the Barkleys to put up a barrier of pine trees/spruce to
obstruct the view rather than to shoot out the camera or destroy it
since the picture is being transmitted somewhere and it might
constitute another charge (vandalism) against the Barkleys if the
person destroying the camera can be identified on the video record.
Will keep you posted on this.
Also, found out that Lyle Barkley
left the US Army as a SP5 (E5) Combat Engineer in Vietnam. This is
great news. He is presently constructing his defensive positions
according to standard field SOP. He is also constructing a billeting
area for reinforcements to include toilets, cooking facilities, and
water. The cantonment area will be away from the homes, but within view
to provide some much needed privacy for the Barkley family. Respect for
the Barkley's privacy should be our concern.
I would recommend
that those coming to support the Barkleys deploy in squad strength on a
rotating basis. This way teams can be kept on the property for certain
period of time for as long as necessary.
What IS needed is a
communication specialist able to set up a short-wave transmitter or
2meter rig able to contact reserve forces immediately should an attack
come. I suspect that power and telephone will be cut and that EMP
devices will be deployed to disrupt electronic communication.
Therefore, an hourly status report to reserve forces in waiting should
be maintained. That way, if a status report is missed, an alert can be
initiated and reserve forces sent in immediately.
I urge anyone
traveling to the Barkleys to bring whatever provisions are needed for
sleeping. I also urge folks to bring gloves and necessary equipment to
build bunkers as necessary once they arrive. With his knowledge of
combat engineering, Mr. Barkley can supervise, but there'll be the need
for some lifting and filling sandbags. Bring your shovel.
We also
need someone who can coordinate the teams. I suspect that the deadline
will come and go without incident on that day. The "enforcers" will
watch our buildup and our deployment. What they should see is
a well-oiled, disciplined military unit able to think clearly and act
with all necessary discretion until the time comes to "lock and
load".
Mr. Barkley will also help construct a properly reinforced
headquarters facility housing the on-site command staff. Backup
generators will be available if needed.

Hello Joseph, This is Charles McClure, Kim's
Boyfriend. Thanks for all of your help. Kim has already left for work but
I'm sure that she will read this as soon as she gets home. I forwarded

situation that have not been shown to the public.. Judge May did not
sign his oath of office on time to be legally a Judge.. He also during
the trials sat on his bench and winked at his friends (the prosecution and
township officials) that is one of the biggest reasons that I am wanting
to stand here and fight. Such disrespect for our rights of a fair trial.
There were a lot of misdoing by the Judge and township during the trials.
There was no point of even going the outcome would have been the same as

Alanson, MI - "I've had
enough. I'm going to fight!" Charlevoix County Businessman, Lyle Barkley,
has been ordered to remove two manufactured homes from a 4-acre parcel in
Bay Township by September 18. Barkley says he will not comply with the
illegal and unconstitutional order of the court but will defend his
property with arms if necessary. Barkley, 55, owns B&B Excavating in
Boyne City. He is presently bulldozing fortifications around his property
in preparation for the standoff he promises will come if officials attempt
to remove the homes from his land. His cause has drawn the attention of
Rick Stanley, leader of an organization called Mutual Defense Pact 2d
American Revolution Militia who offers to send more than 600 armed
defenders to Barkley's aid once the standoff has begun.
Barkley
contacted Norm Olson, a well-know Michigan Militia figure for help up
until Stanley's organization arrives. Olson has urged citizens throughout
Michigan to become aware of what is taking place and to speak out in an
attempt to forestall or stop armed conflict. "Lyle Barkley is unlikely to
run. He's preparing to defend. I admire his spirit," Olson said in a news
release Thursday, but added, "This situation stinks of crooked politics,
corruption, and favors. Barkley was given permission. He acted accorded to
the permits, and then, when his homes were on the property, the permits
were withdrawn and the homes 'red-tagged.' Something about this isn't
right."
Background: Lyle Barkley received authorization to place
two 12x60 manufactured homes (mobile homes) on 4 acres in Bay Township.
Permits were granted by the County. Once on the property, Barley began a
building project to join the two homes via an enclosed walkway. It was
then that former township supervisor, "Bud" Chipman filed a complaint to
stop further construction and have the homes removed. (Chipman was
recalled from his position. Reason unknown).
County Court Judge May
found in favor of Chipman's complaint and issued an order to Barkley to
remove the homes by September 18th.
Barkley's decision: To
bulldoze revetments and redoubts for defenders.

BAY TOWNSHIP, Mich. -- A
Michigan property owner is promising an armed confrontation with anyone
who attempts to enforce a judge's order to remove three manufactured homes
from his land.
Judge Richard May of Charlevoix County District
Court ruled Aug. 28 that the homes' placement violated Bay Township zoning
ordinances and ordered them removed by next Thursday.
"We're going
to have a standoff," Lyle Barkley, 55, told the Traverse City
Record-Eagle. "I'm not going to let them come in here and take this stuff.
Over my dead body."
County Sheriff George T. Lasater said while he
does not want any violence, the threat of it will not prevent him from
carrying out the judge's order.
"I'll do everything possible to
come to a peaceful resolution of this situation, so nobody gets hurt on
either side," he said. "But rest assured, I'll do my job, and I will
follow the orders of the court."
The dispute centers on Barkley's
placement of two, 12-by-60-foot mobile homes on the property and a
24-by-34-foot trailer originally built as a portable school classroom.
Barkley said he considers the two mobile homes to be additions to
two existing trailers on the property. He and his wife, Shirley, live in
one of the existing homes. His daughter, Kimberly, her boyfriend and three
children live in the other.
Barkley's son and his family live in
the former portable classroom.
After initially receiving zoning
permits from the township in summer 2002, Randy Frykberg, the township's

HORTON BAY - The peaceful,
rolling farmland of Charlevoix County's Bay Township belies the potential
armed confrontation that may develop there in a matter of
days.

ordered the rear unit removed, an order the Barkleys say they will not
honor.
A county district court judge has ordered by Thursday the
removal of three manufactured homes from four acres on Camp Daggett Road.
The family who owns the property is vowing an armed confrontation with
anyone who attempts to enforce the judge's order. "We're going to have
a standoff," said Lyle Barkley, 55. "I'm not going to let them come in
here and take this stuff," he said. "Over my dead body." Barkley and
members of his family may not be alone in their standoff. A Denver-based
organization calling itself The Mutual Defense Pact - Second American
Revolution Militia has vowed to call on 600 or more armed individuals from
across the country to defend the Barkleys' property. "Within a few days
of (Barkley) being attacked, that little township will become the center
of the universe, by force of arms," said Rick Stanley, founder of the
militia group. Barkley has created an earthen berm on his property, and
said he planned to create trenches as well, in preparation for a
standoff. Charlevoix County Sheriff George T. Lasater said he hopes
violence can be avoided. "I'll do everything possible to come to a
peaceful resolution of this situation, so nobody gets hurt on either
side," he said. "But rest assured, I'll do my job, and I will follow the
orders of the court." The dispute involves the placement by the
Barkleys of two, 12-by-60-foot mobile homes on the property, and a
24-by-34-foot former school portable. Barkley said two of the units are
additions onto two existing mobile homes on the property, one of which
Barkley lives in with his wife, Shirley; and another in which his
daughter, Kimberly, her boyfriend and three children live. Barkley's son,
Ken, and family live in the third - the school portable unit. After
initially receiving zoning permits from Bay Township in the summer of
2002, the permits were revoked by township zoning administrator Randy
Frykberg that November. Frykberg said Thursday the Barkleys had
initially applied for additions, not to add additional mobile homes.
Township attorney James Murray said no township or city in the state would
allow the sandwiching of a manufactured house on an already nonconforming
structure under zoning. "It's a very basic question - it's a health,
safety and welfare question," Murray said. "This is simply a case of
abiding by zoning, and abiding by the construction code. (Barkley)
blatantly disregarded both." Barkley, however, countered that he was
willing to make any changes necessary to bring the buildings up to code.
He was never given that chance, he said. After Judge Richard May's
ruling in April siding with the township, Barkley said he went ahead and
installed the manufactured homes on his property over the summer. On
Aug. 28, May ruled Barkley, his wife and Kimberly Barkley were in contempt
of court. He ordered the buildings removed by Sept. 18, and ordered the
Barkleys to pay an $800 fine. The Barkleys face 26 days in jail if the
fine is not paid by Thursday. "I won't pay it," Barkley said. "If I pay
it, it's the same as saying I'm guilty." Stanley, of the Second
American Revolution Militia, said Barkley is a member of his militia's
mutual defense pact, which he said is about four months old. "We
basically are not going to tolerate unconstitutional acts by governments
in the future," Stanley said. "They do this kind of thing thousands of
times a day, every day, across the United States. But we've drawn the line
and said, 'Not with our pact members.' "
This blog has been created for the sole purpose of
disseminating information about Lyle Barkley and his family. They live in
Bay Township, Michigan on 4 acres of land, which they own. Mr. Blakley is
a businessman, providing excavation services to the area.
During
this past summer, he wanted to install three mobile home structures on his
land for his mother, his grown daughter and for his own family. He filed,
paid for and received all necessary permits.
After the structures
were in place, he learned that his permits were revoked.
Following
investigation, he discovered that a "good old boy" network of bullies was
using the local court system to have their way.
Unfortunately for
Mr. Barkley, the Judge in his case is a part of the group.
This
situation has so enraged Lyle Barkley and his family that he has decided
to draw the line and not allow meanies to bully him and his loved ones,
not even under the color of law.
I'm not sure if he owns a home
computer, or if he even has an interest to blog, but if he does, this blog
has been started so that Lyle and his family may write directly to you,
the public, about the rapidly unfolding events.
Media has a way of
spinning a story in harmony with the agenda of the powers that
be.
It's time that an individual have access to the concerned
public, without that filter.

confrontation with anyone who attempts to enforce a judge's order to
remove three manufactured homes from his land.
Judge Richard May of
Charlevoix County District Court ruled Aug. 28 that the homes' placement
violated Bay Township zoning ordinances and ordered them removed by next
Thursday.
"We're going to have a standoff," Lyle Barkley, 55, told
the Traverse City Record-Eagle for a story Friday. "I'm not going to let
them come in here and take this stuff. Over my dead body."

their property and have enlisted the support of private militia groups.
It's kind of a standoff between our township zoning enforcement here.
Back in June and August we took out zoning permits to put these trailer
houses on our property here and they were issued to us. And then come
along the last part of October and he said my one permit wasn't right. He
said I had to change it. Which I agreed to that. And when I tried to
change it I spent better than three weeks trying to get ahold of him and I
couldn't get ahold of him. So the next thing we get through the mail is
that we've got fourteen days to move this stuff out that it was in
violation of the zoning ordinance and they took us to court in February or
March it was. And at that time the Judge ruled that we move the trailer
houses out and give us 90 days and an $800 fine. And I couldn't see where
we'd done anything wrong.
